Q:How is The Milestone Foundation different from other funders?
A:

We charge just 15% simple interest — never compounding — for pre-settlement funding, and 10% simple interest for post-settlement funding. Our funding is always non-recourse. We are interested in helping people first and foremost, not making a profit.

Q:What is pre-settlement funding?
A:

Pre-settlement funding, or a lawsuit advance, is a cash advance provided to you to cover essential living expenses while waiting for your lawsuit to settle. It is not a loan, as repayment is only required if you win your case.

Q:What is post-settlement funding?
A:

Post-settlement funding, is a cash advance provided to you to cover essential living expenses if you have already signed a settlement agreement and need an advance urgently.

Q:Do I have to repay if I lose my case?
A:

No. Our funding is non-recourse, which means if your case does not settle, you owe nothing.

Q:Will applying affect my credit score?
A:

We never run credit checks and your credit will not be impacted.

Q:What expenses can funding cover?
A:

Advances are intended for essential living expenses such as housing, utilities, groceries, and reliable transportation.

Q:Is the process to apply easy?
A:

Yes, the process is very easy. Just fill out our application and you will hear back from our case manager shortly.

Q:Can I apply for funding without an attorney?
A:

No, you must be working with an attorney on your case in order to receive funding.

Q:Is my attorney's approval required to receive funding?
A:

Yes, your attorney must approve the funding request. Our case manager will reach out directly to them to discuss the case.

Q:What role does the attorney play in the application process?
A:

We coordinate directly with attorneys to confirm case details, but attorneys remain fully in control of legal strategy and outcomes. An attorney does have to acknowledge that they are aware their client is receiving pre- or post-settlement funding.

Q:Why should I refer my clients to The Milestone Foundation?
A:

Referring to The Milestone Foundation ensures your clients receive the lowest consumer litigation funding in the nation. It prevents your clients from taking out funding from for-profit funders who charge high interest rates. A:

Q:Can my firm support The Milestone Foundation beyond referrals?
A:

Yes. Attorneys can join our Membership Program, designate The Milestone Foundation for Cy Pres Awards, become a corporate sponsor, or make a tax-deductible charitable contribution.

Q:Does The Milestone Foundation have an interest cap?
A:

No, we don’t need a cap because we don’t overcharge.

On average, at our rates, it would take an advance 6.67 years to double, and 13.33 years to triple.

100% of gifts go directly toward supporting plaintiffs’ essential living expenses during litigation.

Q:Why does it matter that The Milestone Foundation is a nonprofit?
A:

Being a nonprofit means that our organization exists to advance a mission rather than generate profits for owners or shareholders. Any funds we receive, whether through repaid advances, donations, grants or partnerships, are reinvested directly into our programs, services and initiatives.
